Ensuring Compliance with 119.12’s Notice Requirement
Complying with the notice requirement for attorneys’ fees in Section 119.12, Florida Statutes does not require a separate written notice to an Agency. The statute provides that “identifying the public record request to the agency’s custodian of public records” five business days prior to filing an action will satisfy the notice requirement for attorneys’ fees to attach. See § 119.12(1)(b), Fla. Stat. Thus, including language in a public records request that indicates the request also serves as written notice pursuant to Section 119.12, Florida Statutes, will avoid any hassle of having to submit a separate written notice to ensure attorneys’ fees.
